What Are Your Legal Obligations as a Business Owner?

Under the Work Health and Safety Act 2011 (and state and territory equivalents), persons conducting a business or undertaking (PCBUs) have a primary duty of care to ensure, so far as is reasonably practicable, that the workplace, equipment, and systems of work are safe and without risks to health. For electrical equipment, this means ensuring cord-connected appliances are regularly inspected and tested in accordance with AS/NZS 3760 by a person with the required competency. This is not a best-practice recommendation. It is a legal duty. Failure to discharge it can result in WHS prosecutions, fines, and civil liability in the event of an electrical incident.

What Counts as Electrical Equipment Under the Standard?

AS/NZS 3760 covers all portable cord-connected electrical appliances used in a workplace. This includes power tools, extension leads, portable heaters, computers and monitors, kitchen appliances in staff areas, projectors, and any other device that plugs into a standard power outlet. Fixed installations (wiring, switchboards, fixed air conditioning units) are covered by a different standard and do not fall under the test and tag regime. If it is portable and plugs in, it needs to be tested.

How Often Does Equipment Need to Be Tested?

The testing interval depends on the type of environment in which the equipment is used. AS/NZS 3760 sets out the following schedule as a starting point for most workplaces.

Construction Sites: Every 3 Months

Active construction sites have the most frequent testing requirement due to the high risk of physical damage to electrical equipment. Power tools, extension leads, and portable power boards on construction sites must be tested every three months. WorkSafe inspectors visit active sites regularly and will check for current test tags on all electrical equipment. Non-compliant equipment will be removed from service immediately.

Hostile Environments: Every 6 Months

Environments including manufacturing facilities, production lines, workshops, commercial kitchens, and outdoor work areas require six-monthly testing. Equipment used outdoors, near water, or in areas where it is subject to physical abuse falls into this category. The six-month interval reflects the elevated risk of damage compared to an office setting.

Office Environments: Every 2 to 5 Years

Standard office environments have the longest testing intervals. Class I earthed equipment in offices must be tested every two years. Class II double-insulated equipment in offices must be tested every five years. While these intervals are longer, the obligation to test and maintain records still applies.

Who Can Carry Out Test and Tag in Your Business?

Testing must be carried out by a competent person. This means someone who has completed appropriate training and holds a nationally recognised Statement of Attainment for the UEESS00174 skill set. Can You Use a Contractor?

Yes. Engaging a qualified test and tag contractor is a valid approach, particularly for businesses with large numbers of appliances or multiple sites. If you use a contractor, verify that they hold a nationally recognised qualification before engaging them. Ask to see their Statement of Attainment. A contractor who cannot produce it is not a competent person under the standard, and their testing records may not hold up under a WorkSafe audit.

What Records Do You Need to Keep?

AS/NZS 3760 requires that records of all testing be maintained. At a minimum, your records must include the date of testing, the appliance identifier, the test result, and the identifier of the person who conducted the test. In addition, every tested appliance must have a tag attached that shows the test date, retest due date, and pass or fail result. These records must be produced on request by a WorkSafe inspector. Businesses that cannot produce records are treated as non-compliant regardless of whether testing was actually done. Store your test records in a format that can be retrieved quickly and easily.

What Happens to Failed Equipment?

Any appliance that fails either the visual inspection or the electrical tests must be removed from service immediately. A failed tag must be attached, and the item must be quarantined from the workplace until it has been repaired and retested or disposed of. Under no circumstances should a failed appliance be returned to service without passing a full retest by a competent person. Allowing workers to continue using known-defective electrical equipment is a serious WHS breach and creates significant personal liability for the PCBU and any managers who permit it.
